On 10 December, the rules change again.

From that date, if your agency uses software that helps make decisions about people, your privacy policy has to say so.

Tenant affordability tools. Prospecting apps. AI that shortlists applications.

Most agencies use at least one. Very few have updated their policy. And that's just one part of what's changed for real estate in the past 18 months.

In 60 minutes, we'll show you what applies to your agency, what to fix first, and what can wait.

This Webinar Is for You If…

  • You're not sure what the 10 December privacy changes are, or whether they apply to you

  • Your team uses tenant apps, AI tools or prospecting software, and nobody has checked what that means for your privacy policy

  • You're not sure what you'd do first if client data ended up in the wrong hands

  • You've heard individuals can now sue directly and want to know where the real risk sits

  • A landlord asks for the full tenant application and you're not sure what you can hand over

"We're too small for the Privacy Act."

It's the most common thing we hear, and it's often not the whole story.

Yes, there's a $3 million turnover threshold. But look at the contracts you've signed with your CRM, your tenant database or TICA. Many of them include a promise that you'll handle personal information as if the Privacy Act applies to you.

If you sell property, you're now an AML/CTF reporting entity. That means the Privacy Act applies to the personal information you collect for AML, whatever your turnover.

And if you manage properties in NSW, turnover will soon be beside the point. New tenancy laws will apply the Australian Privacy Principles to tenant application information, whatever the size of your agency.

Now add the 2Apply decision. The Privacy Commissioner found the platform collected more renter information than it needed, and collected it unfairly.

The lesson for agencies is simple: "the software asked for it" is not a defence.

What It Costs To Leave It

1,205 data breach notifications were made in 2025, the highest number on record.

Individuals can now sue for serious invasions of privacy, with damages of up to $478,550 for loss such as emotional distress.

For serious or repeated interferences with privacy, the maximum penalty for a company is at least $50 million.

The bigger cost is usually trust. Clients hand you their details because they expect you to protect them.

The Shift

Privacy compliance isn't a policy you file and forget.

It's a handful of documents and habits that make sure your team collects only what it needs, protects what it holds, and knows exactly what to do when something goes wrong.

Get those right, and you're protecting your clients, your agency and your reputation in one move.
